By accessing and using AgentListingAI ("the Service"), You accept and agree to be bound by the terms and provisions of this agreement. If You do not agree to these Terms, please do not use the Service.
2.0 Description of Service
AgentListingAI provides an AI-powered platform for generating real estate listing descriptions. The Service is designed for institutional real estate agents and professionals who wish to create property descriptions efficiently.
3.0 User Responsibilities
- You are responsible for the accuracy of property information You provide.
- You agree not to use the Service for any unlawful purpose.
- You are responsible for reviewing and editing AI-generated content before publication.
- You agree not to misrepresent AI-generated content as personally written.
4.0 Data Usage
We prioritize Your privacy and the security of Your property data. User data is processed locally to generate descriptions and is explicitly NOT used to train third-party foundation models or any global AI models. We do not retain Your listing input data beyond the immediate session processing requirements.
5.0 Intellectual Property
Content generated through our Service may be used by You for Your real estate marketing purposes. However, the underlying technology, branding, and platform software remain the exclusive property of Digital Assets Division.
6.0 Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranty of any kind. Digital Assets Division does not guarantee that AI-generated content will be error-free, factually accurate, or suitable for any particular purpose. Users are strictly responsible for reviewing and verifying all generated content prior to professional use.
7.0 Limitation of Liability
To the maximum extent permitted by applicable law, Digital Assets Division shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from Your use of the Service or reliance on any AI-generated content.
8.0 Indemnification
You agree to indemnify, defend, and hold harmless Digital Assets Division, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from Your use of the Service, Your violation of these Terms, or Your misuse or failure to verify any AI-generated content before public distribution.
9.0 Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Alberta, Canada. The arbitration shall be administered by a recognized arbitral body pursuant to its comprehensive arbitration rules and procedures.
10.0 Governing Law
These Terms, and any dispute arising from the relationship between You and Digital Assets Division, shall be governed by and construed in accordance with the laws of Alberta, Canada, without regard to its conflict of law provisions.
11.0 Modifications to Terms
Digital Assets Division reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
